I faced a similar situation during my first L1B extension. My L1 extension was filed, but not approved while my L1 visa expired. Per my (then) attorneys advice - it isn't an issue if the application to extend has been applied for. You can be out of status for upto 180 days in such situations. Only issue is if the extension is rejected during this period.
In the future, the receipt for having filed for extension before Visa expiry and/or Received Date on I-797 Notice of Action (approval) can be used as proof. Of course, travelling out of the country and back on a new visa removes the stigma of having been "out of status"
RFE is okay, but rejection is NOT! Do answer it (RFE) in time. Rejection can put you in trouble. Also if the period extends beyond 180 days due to RFE you will be in trouble ( I really doubt it happening but you never know)

As long as you never out of status from the last time you reenter US (Aug 97) you should be OK and should submit your I485

IMHO, Father & Son "feels" better, while Solitary Fisherman would be the best technically if it were cropped tighter (moreso on the left and top, being careful on the latter to avoid centering him or getting him high in the frame). To me, the rest of the shots have too much distracting material in the background (including Solitary #2, though that one is not as bad as the others, and the distracting element could be "solved" in Photoshop if the contest allows this ;)).
Edit to add more thoughts: If anyone tells you that you suck, keep practicing and prove them wrong (they're probably jealous anyway because they're even worse). I still have trouble with distracting backgrounds - that's probably the most frequent reason I send frames to the circular file, after technical errors (exposure, focus, etc.). Practice, not hundreds or thousands of frames per day of thoughtless practice, but concentrated, thoughtful practice, engaging the mind and paying attention to what's in the viewfinder (and what isn't, and what shouldn't be), is the way to improve. :)

Hi!
I was wondering if you guys know any link on Dept on labor (or uscis.gov) that says that employer is responsible for all the legal(lawyer) fees. I work for a government firm and they only pay H1b fees that they are supposed to pay to USCIS. At the same time, they force me to hire a lawyer (I cannot file it myself) and they want me to pay for the lawyer.
I was wondering if you know of any law that I can show them and ask them to pay for the same.

The 300D and D50 would be too limited in my humble opinion, such that if you plan to buy a body and keep it for a while, you'll run into their "issues" after a little while. Definitely consider 350D or D70(s), along with as good of a lens as you can afford. The 18-70 DX kit lens for Nikon cameras is good from what I've seen from it, but the Canon 18-55 kit lens is sometimes said not to be quite so good. I don't know what to recommend on the Canon side, but there are plenty of folks here who can help you out on that. :)
For what it's worth, I got into photography with an old manual film camera when I was about 9. Then, a few years ago for a very short time, I used a Kodak P&S digital, before getting disgusted with it and going back to film. Finally, this spring my wallet suffered major damage with a used D1 and a couple of lenses (24-85 zoom and 90mm macro). College (this fall) will probably put an end to my photographic acquisitions for a while, but now that the Luminous Landscape did an article on video cameras, I have even more stuff to dream / drool about. Must... hide... credit card... now..! :D

People come to IV because they think that there are some good people who would suggest and help.
And please remember one thing, if you are in a hurry and dont have time. you would not think about browing or searching, but post your quesiton. And who knows he might have even done his browsing and asking for experts opinion.
And IV is an org and it at their wish and will of individual whether to contribute or not.
so please do not force any one.

I hold a H1b Visa but did not work after coming to US.
Can anybody guide me regarding my current status.
My H1 was approved in 2007 quota and i entered US in march 2008..but was not successful in getting a job and my employer is not running any payroll..
can anybody help me with this??

hi guys.
did not mean to turn this into a canon - nikon debate. im just strongly considering switching to a better known brand. the biggest problem i have with pentax is that their products are not as readily avalible.
eg. a local camera store will have 20 canon products 20 nikon products but onley about 5 or 6 pentax products in stock. simpel stuff like a cabel sutter release i had to wait 3 monthes for. if i had a nikon i could have gotten a fancy programabal cabel release. a lot of little stuff like that is one of the big reasons that i am considering nikon or canon.
i dont have alot of glass invested in pentax yet and i think it would be better to change now before im stuck with 5grand worth of pentax and then really neading to change my sistem.
im planing on spending some money on lenses and would rather invest in nikon than pentax. im also pritty sure that i would rather go nikon than canon, no offence mats, but i know alot of photographers who are happy with nikon and i just like the look and feel of nikon more than canon. so now the onley quistion left is d50, d70, or d80...

SKIL exempts applicants with a masters degree from the US and 3 years experience from the annual quotas. This along with not counting dependents should bring considerable relief to even the folks who are still subject to quota.

I think this might be the case where "Waiver of Signature" was not opted in case of express mail.
In that case, USPS has to deliver only if a signatory is available. This is obscure option on the Express Mail address sheet. For PO Box addresses like in this case, it is advisable to opt for waiver for obvious reasons.
In this situation, I guess nothing much to do except wait I guess.

I didn't find what I am looking for.
I already have a lawyer and the ONLY reason I want to file myself is because I am fed up in chasing lawyers, my company etc. They don't respond in time and anyways I am preparing all my documents my self and guiding lawyer also.

I applied for H1 extension in June'07. I got RFE on I94 first & then one more on my consulting company. Both were responded on time.. Finally, I got a denial notice on my H1 recently stating that my education background is not Computer Science related although i hold a Bachelor Degree in Computer Science. Am very upset after hearing this.
I have few questions for the experts here.
1. Is it possible for me now to apply for new H1 thru some other company?
2. Can i re-appeal the decision and stay here legally?
3. Are there any good attorneys that can give me good advice for me to take the next step?
Please let me know.. This is urgent for me right now.

My 485 petitions returned now we are in process of resubmitting. However, I see my I-140 was applied in Nebraska on Feb 07 and later my 485 petition on Aug 07 was sent to Texas from my employer. I do understand there are intertransfer between Nebraska to Texas.
My question is it right to submit 485 pettion to Texas when I-140 is pending at Nebraska? Gurus! please answer ASAP so that I can make sure atleast my company files in correct service center this time.

I have heard that there is a Fiancee visa - K visa or something. Do look into that if you would like to bring in your would-be here before your marriage. To your original question, your strategy sounds cool to me. Marriage etc. are important decisions, that affect you life-long, much more important than stupid GC, work visa etc. I would recommend, follow your strategy, file your I-140 as soon as you can and then wait to get married before you file your 485. Since you are from a non-retrogressed country and EB2, you should not have to worry about backlogs etc. Good Luck.

Mine & my wife's 485s were wrongfully denied last year.
We gave USCIS a chance to fix their mistake on the file. They fixed it.
If they shouldn't have fixed it , I would be a mini millionaire by now :)
But, my online status still shows as denied. Last month we got our
EADs and APs renewed without any issues. So, I don't care about the
online status.
Mine & my wife's 485s were wrongfully denied last year.

Last month I called TSC and got a really nice IO. I was checking on my FBI name check status and he told me that he can get more details by A# instead of receipt NO. He in fact found my A# as i only had receipt number handy. He than told me that the FBI checks are cleared and my case is assigned to an IO.
Does case assigned to an IO means that when Visa nos are available i have chance to get GC? Does it mean it is adjudicated and waiting for visa NO?

The backlog centers have 10 fed govt employees and 100 guys from Exceed unless I am egregiously mistaken.
Why does any one think that those 100 guys will be left out with out any jobs? Wont the 10 fed guys be moved to Chicago/Atlanta NPC's with huge reloc benefits package? If they dont choose to move because of personal reasons, Do you know what kind of severance packages they get?
100 guys from Exceed will be definitely working for other fed agencies after they are done with this gig. IRS has a huge base in Philly and Exceed is a govt contractor. May be IT consultants need to learn from these folks..
